Terms of Service

GuestPortals provides a hosted captive portal platform that lets businesses configure a branded guest wifi sign-in page, collect guest contact information, and integrate that data with third-party marketing and review tools. We also sell pre-configured wireless access points as an optional hardware add-on.

You must be at least 18 years old and legally able to enter into a contract in your jurisdiction. You're responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

You may not use the Service on behalf of a sanctioned entity or for any unlawful purpose.

GuestPortals is offered on recurring monthly subscription plans (Free, Solo, Hosts, Manager, and Pro). Each plan has published limits on the number of physical sites (captive portals) and a fair-use monthly sign-in cap. Current plan details are listed on our pricing page.

Paid plans bill monthly in advance through Stripe. By subscribing, you authorize us to charge your payment method on the first day of each billing cycle until you cancel. Prices are in US dollars and do not include any applicable sales tax, which we collect as required by law through Stripe Tax.

Fair-use sign-in cap: if your account exceeds the monthly sign-in cap for your plan, we will continue to serve your guests without interruption but will email you to ask you to upgrade. We reserve the right to require an upgrade or reduce service if a customer chronically exceeds the cap for their plan.

Cancellation: you can cancel from the billing page in your dashboard at any time. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for partial months, unless required by law.

Hardware sold through GuestPortals (the GP Mini, GP Standard, and GP Pro access points) is sold one-time, with free shipping within the continental United States. Units are pre-configured to your portal before shipment. Hardware is covered by the original manufacturer's warranty; contact us for help facilitating a warranty claim.

Hardware returns are accepted within 30 days of delivery provided the device is in resellable condition. Return shipping is the customer's responsibility. Email support to initiate a return.

You are the data controller for any personal information you collect from guests through your GuestPortals deployment. We act as a data processor and store that data only as necessary to provide the Service. See our Privacy Policy for details.

You represent and warrant that you have a lawful basis to collect guest data through your captive portal, that your sign-in form clearly discloses what data is collected and how it's used, and that you comply with all applicable privacy laws (including GDPR in the EU/UK and CCPA/CPRA in California).

You agree not to:

• Use the Service to collect or process data in violation of any law
• Send spam or unsolicited commercial messages to collected guest addresses
• Attempt to reverse-engineer, disassemble, or circumvent any security mechanism in the Service
• Resell, sublicense, or white-label the Service without our written permission
• Use the Service to host splash pages with adult, hateful, illegal, or malicious content
• Use the Service to store or transmit malware, phishing content, or infringing material
• Overload our infrastructure with automated traffic outside the documented API rate limits

Violations may result in suspension or termination of your account without refund.

We target high availability but do not currently provide a formal SLA. The Service is provided "as is" without warranty of any kind. Downtime for maintenance, network issues, or upstream provider outages may occur. We'll post status information on our status page when available.

GuestPortals, the GuestPortals name, logo, and dashboard software are the property of Kos Holdings LLC. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of any content you upload (logos, splash backgrounds, copy) and grant us a license to display that content to your guests as part of providing the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUESTPORTALS'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.

You agree to indemnify and hold harmless Kos Holdings LLC and its affiliates from any claims, damages, or expenses arising out of your use of the Service in violation of these Terms, your misuse of guest data, or your violation of any third-party rights or applicable law.

You may cancel your subscription at any time from the billing page. We may suspend or terminate your access if you violate these Terms or fail to pay fees. On termination, your right to use the Service ends. We will retain your guest data for 30 days after cancellation to allow you to export it, then permanently delete it.

We may update these Terms from time to time. Material changes will be announced via email or in-dashboard notice at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law principles. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Marion County, Oregon.
